1. How To Enter: The Troy-Bilt Love-Your-Yard Makeover (“Sweepstakes”) begins 12:01 a.m. Eastern Time (“ET”) on March 5, 2008 and ends 11:59 p.m. ET on May 25, 2008 (“Sweepstakes Period”). To participate in the Sweepstakes and gain an entry into the Sweepstakes Drawing, visit www.troybiltsweeps.com during the Sweepstakes Period, click on the Sweepstakes link and fill in all required registration information. All eligible entries must be received by 11:59:59 p.m. ET on May 25, 2008, to be entered into the Sweepstakes Drawing. Limit one entry per person/household/day. Normal Internet access, phone/usage charges imposed by your on-line/phone service will apply. All entries become property of the Sponsor. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified.
2. Grand Prize: Grand Prize (1): Personal Lawn and Garden Consultation and Plan with Justin Cave, host of “Ground Breakers” on HGTV, Execution of the proposed Lawn and Garden plan up to $3,000, Troy-Bilt Mustang™ Zero-Turn Mower, TB1086 XP Series™ Walk-Behind Mower, Pony™ Garden Tiller, TB70SS String Trimmer. Approx. Retail Value (“ARV”) $17,392. Consultation with Justin Cave will be set up based upon a mutually-agreeable date for him and winner. Prize is non-transferable and no substitution is permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute a prize of equal or greater value, if prize becomes unavailable. Prize must be redeemed within one year from winner notification. Void where prohibited by law and subject to all federal, state and local laws.
3. Random Drawing: Grand Prize winner will be selected in a random drawing on or about May 28, 2008, from among all eligible entries received throughout the Sweepstakes Period. Drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. Odds of winning depend on the total number of eligible entries received.
4. Eligibility: Open to legal residents of the 50 United States, 18 years of age and older as of March 5, 2008. Employees of Troy-Bilt LLC, MTD Products Inc., MTD Consumer Group Inc., Marcus Thomas LLC, HGTV, Don Jagoda Associates, Inc., and each of their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies and the immediate family members of each, are not eligible to participate or win. Void where prohibited or restricted by law.
5. General Rules: Troy-Bilt LLC, MTD Products Inc., MTD Consumer Group Inc., Marcus Thomas LLC, HGTV, Don Jagoda Associates, Inc. and each of their parent companies, subsidiaries, affiliates, advertising and promotion agencies, and all of their officers, directors, employees, shareholders, and agents (collectively “Releasees”) are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or for any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error which may occur in the processing of the entries in this Sweepstakes. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or Website; violates these Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the promotion if it is not capable of running as planned, including, but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures or any other problems beyond the control of the Sponsor and award prize from among all eligible entries received prior to the action requiring such modification. In the event of a dispute as to the identity of a winner, the entry will be deemed made by the authorized account holder. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. The Releasees shall have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or any prize awarded. Participants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of prize. Information collected from entrant is used only for the purpose of the Sweepstakes drawing and to notify winner, and will not be re-used, sold or shared in any manner by Troy-Bilt LLC, MTD Products Inc., MTD Consumer Group Inc., or any third parties unless entrant has elected to receive additional information and promotional material from Troy-Bilt LLC and/or MTD Products Inc. or MTD Consumer Group Inc., or a third party. Notice to entrants: Internet access and usage charges applicable to an entrant’s account, including, local, long distance, 800#, or 888# access charges to connect to any Internet provider, and/or any usage charges applicable under entrant’s pricing plan and any applicable taxes will continue to apply while an entrant is online in connection with this Sweepstakes, and will be the sole responsibility of such entrant.
6. Releases: Grand Prize winner (or his/her parent/legal guardian if winner is a minor in his/her state of residence) will be required to sign and return an affidavit of eligibility and liability and publicity release, except where prohibited, within ten (10) days of notification before prize is awarded. If winner fails to return the affidavit of eligibility within ten (10) days or if winner is ineligible, the prize will be forfeited and an alternate winner will be selected from all eligible entries received. If potential winner is not reachable at the address provided and a forwarding address is not made available or if prize is returned as undeliverable, then the prize will be forfeited and an alternate winner may be selected. Entry in the Sweepstakes constitutes permission to use winner's name, address, quotes, utterances and likeness for promotion or business purposes without further compensation except where prohibited by law; and winner by acceptance of a prize, agree to release the Releasees and other participating partners in the Sweepstakes from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons (including, without limitation, death and bodily injury) and property of any kind resulting in whole or in part, directly or indirectly, from acceptance, receipt, or use or misuse of the prize offered, or participation in the Sweepstakes or any Promotion-related activity.
